General Terms of Conditions & Services
Appointment Arrival
We recommend that you arrive at least 15 minutes prior to your appointment time to check-in, chill, and grab a beverage from our coffee bar.
Cancellation Policy
Services you select are reserved especially for you. We require a minimum of 24 hours advance notice for cancellation of services. If you are within this booking time, you are already confirmed for your treatment and the cancellation policy will be in effect. Without this notification, you will be billed 100% for each service. If you cancel your appointment within the 24 hours, you will be billed 50% of the service. If you reschedule your appointment within the 24 hours, you will be billed 20% of the service. A credit card account number is required at the time of booking. This policy also applies to gift card holders.
Late Arrival
All spa appointments have been designed to allow the appropriate time for the full enjoyment of the service. Your late arrival may limit our ability to offer the fullest experience possible. Please understand that late arrivals will not receive an extension of scheduled services. An un-rushed service will be rendered only for the remainder of the scheduled session. You will be responsible for payment of the full original service.
Return Policy
Unused products in original packaging may be returned within 14 days for a full refund at Modern Allo, 5865 W Ray Rd, Chandler, AZ, 85226.
Refund Policy
We have a no refund policy on services completed at our salons. We offer complimentary fixes within 7 days of the service completion pending management approval.
Gift Certificates
Gift Certificates may be redeemed for spa services, products, merchandise, and childcare. Gift certificates are to be treated as cash, as we are unable to replace lost or stolen certificates. All Gift Certificate sales are final and cannot be refunded.
Health Conditions
Please advise us of any health conditions, allergies, or injuries that could affect your service when making your reservation.
Massage Services
Please speak with the therapist directly about style and depth of pressure preferences.
Nail Services
Please know that we do not provide acrylic nail services.
Receiving treatments under 18 years of age
You must be 18 years of age to receive treatments on your own. If you are under 18 years old, you will need written and signed consent from a parent or legal guardian and they will need to be present in the treatment room during your appointment.
Pregnancy
We have a specially designed service for expectant mothers. Please note that pre-natal massage can only be performed after the first trimester is complete.
Payment
We do not have an ATM on premise. All major credit cards accepted. We do not accept personal checks.
Gratuity
Rates do not include gratuity. A gratuity of 20% is both appropriate and appreciated.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS
AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY! BY SIGNING THIS DOCUMENT, YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT ON YOUR BEHALF AND ON BEHALF OF YOUR CHILD/CHILDREN
In good and valuable consideration for allowing my minor child (the “Minor”) to participate in events and activities that occur at The Rosebud Group LLC, dba Modern Allo, 5865 W Ray Rd #7, Chandler, AZ, 85226, USA, I hereby represent, warrant and agree that:
1. I am the custodial parent or legal guardian of the Minor or have obtained parental authorization to act on their behalf with respect to the Minor for this purpose (the “Guardian”).
2. I am familiar with and accept that there is the risk of serious injury, permanent disability, and death in participation in the activities at Modern Allo.
3. I have read and fully understand the terms herein. I freely and voluntarily assume and accept all of said terms and all of the risks associated with my and the Minor’s participation in the activities at Modern Allo.
4. I have satisfied myself and believe that I and the Minor are physically, emotionally and mentally able to participate in the activities at Modern Allo, and that my and the Minor’s clothing is fit and appropriate for the participation in the activities.
5. I fully understand that all applicable rules for participation must be followed and that at all times while at Modern Allo, the sole responsibility of my and the Minor’s personal safety remains with me.
6. I will immediately cease participation or remove the Minor from participation in any activities at Modern Allo and advise Modern Allo staff, if at any time, I sense or observe an unusual hazard or unsafe condition or if I feel that I or the Minor has experienced any deterioration in physical, emotional or mental fitness, or the condition of our clothing for continued safe participation in the Event.
7. I have reviewed and agree to comply with Modern Allo’s rules and policies and any instructions given by Modern Allo staff.
UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, THE MINOR, AND OUR RESPECTIVE HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:
1. AN UNQUALIFIED ASSUMPTION BY ME OF ALL RISKS associated with my and the Minor’s participation in activities at Modern Allo even if arising from the negligence, gross negligence, including but not limited to any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of or by The Rosebud Group LLC, dba Modern Allo, its, owners, operators, employees, directors, officers, agents, representatives, successors or assigns (the “Releasees”) and any persons associated therewith or otherwise participating in activities at The Austin Hive in any capacity;
2. A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I or the Minor have, or may in the future have, against the Releasees and any persons associated therewith or otherwise participating in activities at Modern Allo in any capacity from any and all liability for any loss, damage, injury or expense that I or the Minor may suffer as a result of my or the Minor’s use of, or presence at, Modern Allo or my or the Minor’s participation in any part of, or my or the Minor’s presence in any capacity at, Modern Allo, due to any cause whatsoever, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE RELEVANT OCCUPIERS’ LIABILITY ACT ON THE PART OF THE RELEASEES;
3. AN AGREEMENT NOT TO SUE THE RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from my or the Minor’s participation in any aspect(s) of activities at Modern Allo;
4. AN AGREEMENT TO INDEMNIFY AND TO SAVE AND HOLD HARMLESS THE RELEASEES, and each of them from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them by or on behalf of the Minor, by me or by that of our estates, whether the claim is based on the negligence or the gross negligence of the Releasees or otherwise as stated above;
5. AN AGREEMENT that is irrevocable and perpetual, and is not subject to termination, revocation or rescission by me, the Minor or any other person for any reason. This Agreement is the entire agreement between the parties, and may be modified only by a written instrument signed by both parties or their successors or assigns. This Agreement is binding on me, the Minor and our heirs, next of kin, executors, administrators, successors, assigns and personal representatives. If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision and everything else in this Agreement shall continue in full force and effect. This Agreement and all related matters will be governed by and construed in accordance with the laws of the state of Arizona, USA and the courts in Chandler, Maricopa County, Arizona will have original and exclusive jurisdiction over any dispute arising from, connected with or relating to this Agreement or any related matter.
6. PHOTOS: I grant Modern Allo the right to take photographs of me and the Minor while at Modern Allo. I authorize Modern Allo to use these photographs for any lawful purpose, including but not limited to displaying the photographs on its website, Facebook page, other social media sites and/or in advertising. I also understand I may opt out of having photographs of me and the Minor taken and used by Modern Allo when I drop my child off for care.

PERSONAL INFORMATION WE COLLECT
